RESOLUTION OF THE BOARD OF DIRECTORS
The Board of Directors has the responsibility to publish and enforce the rules adopted by resolution (as in this policy); the regulations outlines in the CC&R's, ARTICLE SIX through NINE, and per ARTICLE 4 of the Bylaws. Although it is the desire of the Board that few citations should be issued and that all residents, guests and visitors act responsibly, issuing a citation carries out enforcement. A citation can be issued in either of two ways; (1) As a warning or, (2) As a violation to be addressed by the Board of Directors. A member will be issued a citation only when a Staff Member witnesses an infraction. However, the Board of Directors may issue a citation based on a member's complaint and/or evidence of a violation. Nobody will be cited merely on an accusation made by another member unless such accusation is made in writing and verified. A member who is alleged to have violated any of the rules and regulations will be issued a citation by a Staff Member and reviewed by the Property Manager. A copy of all citations, whether issued to guests, renters, etc., will be mailed to the respective property owner. When a violation of the rules and regulations is observed, or a member has failed to take action on a previous warning, the Staff Member or Property Manager will issue a citation. The date of the next Board of Director's monthly meeting will be noted on the citation and provide an opportunity for the member to appear in their defense. When a citation is issued for a violation of the Boat Sticker Policy, the member will have three (3) days to procure boat stickers, within a minimum fine of $10.00. If the stickers are not procured within three (3) days, the member will be given the opportunity to address the Board of Directors in writing or in person to explain why a fine should not be assessed. The Board will review each citation and determine whether to apply a fine, reduce the citation to a warning or dismiss the citation. The decision of the Board of Directors is final, subject to arbitration per the CC&R's. RULES AND REGULATIONS Excepting extenuating circumstances, fines notes reflect the first incident applied to an account in good standing; that is, no outstanding fine for a similar violation. Any continuing violations will be fined in direct multiples of the first incident. (For example: first violation, $50. Second similar violation, 2 x $50 = $100, third, 3 x $50= $150, etc.) The amount in parentheses denotes the high end of a range that can be applied to each citation under extenuating circumstances. (Examples of an extenuating circumstance, as determined by the Board of Directors, could be the alleged violator ignoring the directive implicit in the citation, or relate to the magnitude of the offense.) |
